Micron Technology has reached a global settlement with Fujian Jinhua Integrated Circuit Co., Ltd., which was confirmed in a media email statement by a spokesperson for Micron Technology. According to the statement, the two companies will withdraw their lawsuits against each other globally and end all lawsuits between the two parties. However, detailed details of the agreement were not disclosed, and a spokesperson for Micron Technology remained silent.
This settlement means that the long-standing lawsuit between Micron Technology and Fujian Jinhua has finally come to an end. Looking back to December 2017, Micron Technology filed a lawsuit against Lianhua Electronics and Fujian Jinhua in a federal court in California, USA, accusing Lianhua Electronics of stealing its intellectual property rights, including key technologies for storage chips, through employees in Micron Taiwan and providing them to Fujian Jinhua. This action was deemed to have infringed on Micron's trade secrets.
In the following period, Micron Technology launched a series of legal actions, until November 26, 2021, when United Power announced that the company had reached a global settlement agreement with Micron and both parties agreed to withdraw their lawsuits. At the same time, United Power also agreed to pay an undisclosed settlement fee to Micron, and both sides will jointly explore cooperation opportunities in the future.
Now, two years later, Micron and Fujian Jinhua have officially reached a global reconciliation, ending this highly anticipated storage war.
However, it should be noted that in May 2023, the National Cyberspace Administration issued a notice stating that Micron products have serious cybersecurity issues, posing a significant security risk to China's critical information infrastructure supply chain and directly affecting China's national security. In the legal conclusion of the Cybersecurity Review Office, it is explicitly stated that it will not pass the cybersecurity review. This conclusion has led to operators of key information infrastructure in China being required to stop purchasing Micron products.
This notice has put Micron's products in a severe situation in the Chinese market, and the existence of network security issues has raised doubts about their critical information infrastructure. This global settlement is good news for Micron, but its future development in the Chinese market is still full of uncertainty under the shadow of cybersecurity issues. This has also sparked profound reflection in the industry on how technology companies can balance intellectual property protection, exploration of cooperation opportunities, and complex issues of cybersecurity
